New York —- A federal appeals court on Tuesday ruled that a unit of FedEx Corp. didn’t break federal labor laws when it refused to negotiate with a union that was bargaining on behalf of some of its workers who want to be classified as employees rather than independent contractors.
The vote overturned an earlier ruling by the National Labor Relations board regarding the Massachusetts based workers of FedEx Ground Package System Inc. The International Brotherhood of Teamsters had filed petitions to the board in 2006 alleging the company’s failure to bargain. FedEx has about 13,000 of such employees nationwide. - 4/22/09 Atlanta Journal Constitution

According to two of the principals of law firm Wimberly, Lawson, Steckel, Schneider & Stine, a recent amendment to the Motor Carrier Exemption to the Fair Labor Standards Act may cost motor carriers a lot of money. Passed June 4th, the new law states that employees that work on Motor Vehicles (as opposed to Commercial Motor Vehicles - greater than 10,000 pounds) may be eligible for overtime. Previously, all motor carrier employees were exempt from overtime. - 9/19/2008
